Appeal a parking fine

If you believe your fine should be withdrawn, you can appeal it. We will do an internal review of the fine and advise you of the outcome. You can only do one review for each fine.

Before appealing your fine, you should view the photos taken of your parking infringement. You will need to enter your infringement number and vehicle registration to view the photos.

We also recommend you review what is a valid reason for withdrawal and what isn't a valid reason for withdrawal before submitting your application.

Appealing before a magistrate 

You also have the option to dispute your fine before a magistrate. Please let us know if you would like to do this. 

You will receive a summons advising the date, time and place of your hearing. If your appeal is successful the fine will be dropped. However if you are unsuccessful, you will be liable for the fine plus additional court and Council costs.

You will need to provide all relevant information to support your appeal. This includes copies of any supporting documentation such as letter, reports or statements from supporting parties. Please ensure you also have your infringement notice with you as you will need to enter the Ticket Number.

Once your application has been reviewed, we will write to you within 21 days, advising you of the outcome. 

  • If the infringement is upheld, we will advise you of a new payment date.
  • If the infringement is overturned, we will advise you of the outcome but you wont need to take any further action.

Reasons for withdrawal

If you believe your vehicle, trailer or number plates were stolen at the time the infringement was issued, please complete the Illegal User Statement(PDF, 67KB) and return it to us.

If you were not responsible for the vehicle at the time of the offence but know who was, please complete the Known User Statement(PDF, 71KB)  and return it to us.

If you were not responsible for the vehicle at the time of the offence but DON'T know who was, please complete the Unknown User Statement(PDF, 65KB) and return it to us.

If your vehicle had been sold to another person when the offence occurred, please complete the Sold User Statement(PDF, 73KB) and return it to us.

Please complete the Nomination Rejection Statement(PDF, 67KB) and return it to us.

The following reasons are valid reasons for withdrawal of a parking infringement:

  • Exceptional circumstances - unforeseen or unpreventable circumstances (e.g. medical emergencies).
  • Contrary to Law - the infringement was not valid. You will need to state reasons why this is the case.
  • Special circumstances - mental or intellectual disability, illness, addiction to drugs, homelessness or family violence. You will need to provide evidence to support this. 
  • Mistaken identity.
  • Unaware of the fine - you were not aware of the fine and believe it should be reviewed.

The following are not considered value reasons for withdrawal of a parking infringement:

  • Poor visibility due to weather
  • Not noticing a sign.
  • Reading only part of a multi-panel sign.
  • Being unable to read the sign from the front seat of the car.
  • Forgetting to read the sign because you were concentrating on other things.
  • Not noticing that a sign/restriction had been changed.
  • Being new to the area and unfamiliar with the restrictions (applies regardless of whether the driver is from Victoria, interstate or overseas).

Statement of disclosure

Personal information collected is used solely for the purpose of issuing an infringement notice and any subsequent legal action. 

 

We may disclose this information to the Magistrate’s Court, or its legal advisers, or other organisations where required by law.
