Court orders destruction of dog following serious attack

The Rural City of Wangaratta is reminding pet owners of their responsibilities after a County Court appeal upheld a destruction order for a dog involved in a serious attack on another dog in Wangaratta.
The attack occurred in November 2025 when the dog escaped from the property where it was being kept and roamed the surrounding neighbourhood before entering a nearby property.
The dog scaled a 1.8-metre fence and attacked another dog in its own yard. The dog attacked required emergency veterinary surgery as a result of its injuries.
Following legal proceedings and a subsequent appeal to the County Court, the Court upheld Council's position and ordered the dog owner to pay a total of $15,806.65 in costs. The Court also issued an order requiring the destruction of the dog that carried out the attack.
Celeste Brockwell, Rural City of Wangaratta Manager Economic Development, Environment & Compliance said the outcome highlights the serious consequences that can arise when dogs are not adequately contained or restrained.
"This was a significant incident that resulted in serious injuries to another dog. The Court's decision reinforces the importance of responsible pet ownership and ensuring dogs are securely contained on private property.”
"Simple measures such as maintaining fences and gates, providing secure enclosures and ensuring dogs are appropriately supervised can help prevent attacks and keep the community safe.”
"Dog attacks can also occur when pets are being exercised in public spaces. Keeping dogs on a leash and under effective control at all times is one of the simplest ways owners can help protect their pets, other animals, and the wider community.”
The prosecution comes as concerns about dog attacks continue across Victoria. Victoria's 2024 Pets Census found that around one in five dog owners reported their dog had been attacked by another dog and required veterinary treatment.
